Last week the Rhode Island State Police executed a search warrant on the home of a Rhode Island School Bus monitor in Glocester, Rhode Island and charged the man with possession and transfer of child pornography. The warrant was the result of an investigation initiated by the National Center for Missing and Exploited Children which indicated that the computer at the residence was transferring prohibited child pornography by email. The School Bus Monitor now faces child pornography charges which subjects him to up to 15 years in jail and up to a $5,000 fine, in addition to sex offender registration.</div>

This is a story which, at first blush, the prosecution does not seem to fit the crime. The headline of the article states that the Man who Hacked Bristol County Community College to Change his grades is to plead guilty to federal hacking charges. It appears to be a minor case for the U.S. Attorney to be concerned with bringing federal hacking charges. However, as you dig deeper into the story you will see that not only did the Defendant change his grades, but he also hacked the email of a local police chief and stole credit card data from more than 14,000 account holders. Certainly, hacking into a computer system to steal the account information of 14,000 users will catch the eye of the local U.S. Attorney.<br />

Over Memorial Day weekend, a Hopkinton man was charged with second offense DUI and <a href="https://www.matthewtmarin.com/chemical-test-refusal-charges-in-ri" target="_blank">refusal to submit to a chemical test</a> after he was pulled over in the parking lot of a local liquor store. According to bystanders who flagged down the police, the driver was operating the wrong way on Route 138 and the driver sideswiped another vehicle and failed to stop after the accident. He was also charged with leaving the scene of an accident resulting in damage to property. The man was arraigned at the police station and held on $50,000 surety bail. <u><b>SECOND OFFENSE DUI CHARGES IN RI</b></u><br />
<br />
<div style="text-align: justify;">
In Rhode Island, a second offense DUI charge is an extremely serious offense which carries a mandatory jail sentence if convicted. There are a few conditions that must be met to ensure that a second offense DUI charge is properly brought by the charging police department. Surprisingly, the police departments can frequently charge the wrong offenses. </div>

First, to be charged with a second offense DUI in Rhode Island, you need to have previously been convicted of a criminal DUI charge. This does not including chemical test refusal convictions and it does not include reckless driving convictions, you must have been convicted of a criminal DUI charge.</div>

<div style="text-align: justify;">
Second, the DUI conviction has to be within the past 5 years. This means that if your DUI conviction was more than 5 years ago, the police cannot charge you with a second offense DUI. However, this prior offense will still be used against you as a factor in sentencing, if you are convicted.</div>

<u><b>SECOND OFFENSE DUI PENALTIES IN RI</b></u><br />
<br />
<div style="text-align: justify;">
As indicated above, a <a href="https://www.matthewtmarin.com/second-offense-dui-penalties-in-ri" target="_blank">second offense DUI charge in Rhode Island </a>carries a mandatory jail sentence. If the second offense DUI is a case with blood alcohol content readings between 0.08 and 0.15 or with no readings (BAC Unknown - refusal cases), the mandatory minimum sentence is 10 days in jail. If the second offense DUI is a case with blood alcohol readings over 0.15, the mandatory minimum sentence is 6 months in jail. However, these are mandatory MINIMUM sentences, and prosecutors often seek much longer jail sentences in these cases.</div>

In a recent decision rendered by the Minnesota Supreme Court, the Court ruled in a 4-3 decision that victims of domestic violence are not immune from prosecution for <a href="http://www.matthewtmarin.com/rhode_island_dui_defense_lawyer.html" target="_blank">driving under the influence while escaping a violent situation</a>. The Chief Judge, writing for the majority, wrote:</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
The Domestic Violence victim "contends that she was in fear for her life and that she made
the only choice she could, given her husband’s violent behavior. But it
is also true that when she made that choice, and drove with an alcohol
concentration that was more than twice the legal limit, Axelberg created
a substantial risk to public safety."</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
The Rhode Island Supreme Court has not addressed this issue, however I find the logic and rational put forward by the dissent in this case much more persuasive. The dissent wrote that it is "bad public policy to force victims of domestic abuse to choose between license revocation and personal safety," with which I completely agree.</div>
<br />
<u><b>A scenario that happens more than you might think</b></u><br />
<br />
<div style="text-align: justify;">
In my experience as a <a href="http://www.matthewtmarin.com/" target="_blank">Rhode Island criminal defense lawyer</a>, I have run into this situation a number of times and this is a scenario that happens more than you might think. Oftentimes, this comes from other motorists reporting either erratic driving or a domestic situation in progress. While the Minnesota Supreme Court clearly took the position, although in a 4-3 decision, that victims of domestic violence should not drive under the influence even if they are attempting to flee a violent situation. Obviously, the key aspect of these cases is to ensure that the victim of domestic violence needs to escape the violent situation. While it may not be that an individual is immune from prosecution for driving under the influence, there may be a defense available.</div>
<br />
<u><b>The Defense of Necessity Should Be Used in These Cases</b></u><br />
<br />
<div style="text-align: justify;">
The defense of necessity is a common law defense of justification. Similar to self-defense in that it does not change the fact that the defendant committed a criminal act, it justifies the action and should result in a not guilty verdict. The typical law school example is an individual who sees a tornado coming and breaks into a home to get into the basement and avoid the wrath of the tornado. The act of breaking and entering the home is surely a criminal offense, but the defense of necessity justifies the action and should result in a not guilty verdict. In the situation involving domestic violence, the victim should be able to put forth a necessity defense. However, to put forward such a defense they will need to prove a few important facts: (1) that they were truly in danger of imminent harm, (2) that they did not drive more than necessary to escape the danger, and (3) that they had no other option to escape the danger. If they can prove these facts, they should be able to successfully put forth a defense of necessity and the result should be one of not guilty.</div>

<u><b>POSSESSION WITH INTENT TO DISTRIBUTE HEROIN</b></u><br />
<br />
If you are charged with possession with intent to distribute heroin, then the odds are that you will be held without bail for at least two weeks until a bail hearing can be held. Depending upon the facts of the case, you may be granted bail or you could be held without bail until your case is tried in the Superior Court. The charge of possession with intent to distribute heroin, you are facing a <a href="http://www.ridrugdefenselawyer.com/" target="_blank">major felony offense</a> that carries up to 30 years in prison for a first offense.<br />

A recent decision by the Arizona Supreme Court may provide persuasive analysis for driving under the influence of drugs charges throughout the country, including Rhode Island. The issue decided by the AZ Supreme Court involved the application of the AZ DUI Law to an individual whose blood tests revealed the presence of an inactive metabolite known as "carboxy-THC" which can linger in the blood stream for up to one month after smoking. The substance that produces a high is known as "hydroxy-THC" which is broken down by the body into the "carboxy-THC". The AZ Supreme Court ultimately ruled that the AZ DUI Law prohibited the operation of a motor vehicle while the active metabolite "hydroxy-THC" was present in an individual's system".</div>

<u><b>DRIVING UNDER THE INFLUENCE OF MARIJUANA IN RHODE ISLAND</b></u></div>

The issue decided by the AZ Supreme Court has not been addressed by the Rhode Island Supreme Court. <a href="https://www.matthewtmarin.com/rhode-island-dui-penalties" target="_blank">Rhode Island's DUI Statute</a> prohibits operation of a motor vehicle "while under the influence" of a scheduled drug and operation of a motor vehicle "with a blood presence of any scheduled controlled substance" as shown by blood or urine evidence. It is this second part of the statute that could be impacted by the reasoning of the AZ Supreme Court ruling.</div>

In handling RI Driving Under the Influence of Marijuana Charges, I have seen that different Judges handle these cases differently. Most Judges and prosecutors lack a significant amount of experience and knowledge with respect to these charges and analysis of blood test results in driving under the influence of marijuana charges. With this lack of experience comes a misinterpretation of the blood test results. When the Rhode Island Department of Health tests blood in a DUI case it reports marijuana levels for both "carboxy-THC" and "hydroxy-THC". Without proper knowledge and analysis, most would assume that either would be sufficient to prosecute a Rhode Island DUI case.</div>

Currently, the national standard for driving under the influence of alcohol is federally mandated at a 0.08 blood alcohol concentration. With the 0.08 standard, nearly 10,000 people are killed in alcohol-related motor vehicle crashes. The NTSB has recommended that the federally mandated standard be lowered from 0.08 to 0.05 blood alcohol concentration. With the lower threshold, an average 180 lb male would reach the 0.05 limit after two to three drinks in one hour.<br />

Lowering the drunk driving threshold would cause significant problems for law enforcement in <b>Rhode Island DUI cases</b>. Some possible problems from a lowered threshold include an increasing importance of the margin of error when interpreting breath test results. Attorney Matthew Marin is pleased to announce a successful outcome for a client facing Rhode Island DUI charge in Washington County. The Client had been charged with DUI (BAC Over 0.15) for an incident involving a single car accident in February of 2014. According to the Police, the Client's vehicle had gone off the road and was stuck in a snow bank when they arrived after receiving a call for a disabled vehicle. Upon arriving at the scene, the Police allegedly detected the signs of impairment consistent with drunk drivings and conducted roadside standardized field sobriety testing, which in their opinion the Client failed. The Client was subsequently arrested and at the police station submitted to breathalzyer testing. The results of the Client's breathalzyer test indicated his blood alcohol content (BAC) to be over 0.15, leading to potentially enhanced sanctions if convicted.</div>
<br />
<u><b>Defense Argument: Failure to Properly Advise DUI Rights and Failure to Conduct Proper Administration of the Intoxilyzer 5000</b></u><br />
<br />

After reviewing all the evidence in the case, Attorney Marin was able to identify issues in the advisement of the Client's DUI rights and issues regarding the Police administration of the breathalzyer instrument. A motion to suppress the breath test results was filed and a memorandum also submitted. The key finding by Attorney Marin was a discrepancy between the sequence of events at the Police station as depicted in the Police Officer's narrative and as depicted in the station video obtained by the Defense. After review of all the evidence, the Prosecution today acknowledged potential defects in their case and agreed to reduce the charge from DUI (BAC Over 0.15) to the charge of Reckless Driving.</div>

<u><b>Favorable Sentence Negotiated Including NO LOSS OF LICENSE</b></u><br />

With the amendment to the charge of Reckless Driving, Attorney Marin was able negotiate the resolution of the case by way of a one year Filing (stay out of trouble for one year), NO LOSS OF LICENSE, and court costs. This case will be eligible to be removed from the Client's record in one year and for that one year period does not constitute a "criminal conviction" under Rhode Island law. Because the charge was amended to Reckless Driving, none of the mandatory DUI penalties were imposed. Those mandatory penalties include over $1,000 in fines and assessments, community service, DUI school, license suspension, the payment of a license reinstatement feel, and SR-22 insurance. According to the Providence Journal, the two officers were working a security detail and were attempting to speak with the Defendant after he was ejected from the nightclub. The Defendant then allegedly got into his vehicle and struck one of the officers as he fled the scene, throwing the officer over the hood of the vehicle onto the roadway. The officer sustained no injuries as a result of the incident. Ultimately, the Defendant was arrested and charged with felony assault with a dangerous weapon.</div>

In many cases, getting the prosecution to take a careful look at the facts of the case can be difficult. In this case, a careful review of the facts from the police officer's narrative revealed the following:</div>

"...At that time the Patrolman noticed the man pointing his camera phone at him. At that time, the Patrolman took out his own phone and started recording him."</div>

And then later in the incident, directly from the Police Officer's narrative:</div>

"Finally the Defendant screamed at the top of his lungs 'Am I under arrest or not?' and at that time put his thumb and fore finger in the patrolman's personal space. Feeling the situation escalating, becoming a scene and rapidly getting out of control and based on the Defendant's irrational and excited behavior... warning signs were escalating as he was shifting, yelling more and more and more, and attempting to provoke the Patrolman. The Defendant was <a href="https://www.matthewtmarin.com/disorderly-conduct-charges" target="_blank">apprehended for disorderly conduct</a>."</div>

According to Town Manager Pamela Nolan, the Town of Narragansett has already began taking steps to increase the penalties for individuals who violation local town ordinances. In what has been described as a party that descended into a riot, last Saturday approximately 18 individuals were arrested on various charges during a street party that involved almost 1,000 people. <u><b>Local Narragansett Town Ordinances</b></u><br />

The Town of Narragansett already has municipal ordinances that prohibit unruly behavior including laws banning disturbing the peace, urinating in public, open container of alcohol, and unlawful or underage possession of alcohol. Currently, the minimum fines for disturbing the peace and urinating in public stands at $100 and the minimum fines for alcohol violations is $200. The Town is said to be seeking to increase those fines from $100 and $200 to $200 and $300, respectively. But, there is already doubt that those increases will go far enough to put a damper on these off-campus URI parties. In-fact, it seems fairly obvious that those low level fines will do little to prevent or deter these college students from continued partying.</div>

<u><b>What are Rhode Island's bail laws in a DUI case?</b></u><br />

Generally, whenever anyone in Rhode Island is charged with a criminal offense they are entitled to be released into the community on bail pending a resolution of the case (this is based on the Constitutional presumption of innocence in criminal cases). Rhode Island DUI cases are no different. After you are arrested, you will be released one of three ways. First, you could be held and brought to court. Second, you could see a Justice of the Peace and be released directly from the police station. Third, you could be given a "Summons to Appear" in which you sign paperwork promising to show up for court.</div>

Bail is set by the Court or the Justice of the Peace when you are released from the police station. If you were released with a summons, bail will be set when you appear at your first court date. Typically, an individual charged with a first offense DUI who has no prior criminal record will be released on personal recognizance, also known as "PR" bail. PR bail is your promise to keep the peace while released on bail and your promise to appear for your future court dates. Occasionally, the Justice of the Peace or Court will set "Surety" bail which requires the payment of sufficient surety to be released.<br />

<u><b>Can I drive while on bail in a Rhode Island DUI case?</b></u><br />
<br />
When you are charged with a DUI in Rhode Island, you do not automatically lose your privileges to operate. That means that typically, until you are ordered as a condition of bail to not drive or your license is suspended by the Traffic Court after a hearing for a chemical test refusal, you can drive until you are sentenced on your Rhode Island DUI case.<br />

The party quickly escalated into what law enforcement has described as a 'riot' that included throwing beer bottles, smashing mail boxes, and climbing onto rooftops. The party on Saturday lead to the arrest of 18 URI students.<br />

In my experience these students will face harsh punishment in both the criminal courts as well as their school disciplinary hearings. They are likely facing charges including misdemeanor assault and battery, drunk driving (DUI), disorderly conduct, possession of alcohol by a minor, and local town ordinance violations. In the cases in which I have represented University students, early intervention is key. The student, now defendant, needs to make sure that the school knows he is taking the situation seriously and working diligently to get himself back in good standing with the local community and the school.<br />

Oftentimes, my goal in coordinating with the school's disciplinary officials is to get them to withhold judgement and school disciplinary sanctions until after the criminal court process has been completed. Traffic violations typically form the legal basis for the police to stop a motor vehicle an initiate a DUI investigation. The traffic violation that was the basis of your motor vehicle stop could be anything and does not need to be indicative of impaired operation of a motor vehicle. Typical motor vehicle violations that are issued in Rhode Island DUI cases include laned roadway violations, speeding, time when lights required, and failure to maintain control of a motor vehicle. In addition to these moving violations, non-moving violations can also be used to initiate a motor vehicle stop. Some of these non-moving violations can include inspection sticker violations, license plate violations, and tint violations.<br />

<b>**AN IMPORTANT WORD OF CAUTION** </b><br />
Occasionally, the police will issue traffic violations in a Rhode Island DUI case which provides the defendant with the ability to pay the tickets by mail. <b>DO NOT PAY YOUR TICKETS BY MAIL</b>. <u><b>What is a Summons to Appear in a Rhode Island DUI case?</b></u> <br />

A "summons to appear" refers to a document (usually a carbon copy) that indicates when you need to appear in the Rhode Island District Court to answer for your <a href="http://www.matthewtmarin.com/rhode_island_dui_penalties.html" target="_blank">RI DUI charge</a>. It is issued to individuals that are released from police custody who do not see a bail commission / justice of the peace and who are not brought directly to court from the police department. The summons to appear contains a few important pieces of information: (1) the charge, (2) the court date, and (3) the location of the court where you are expected to appear. If you do not appear on the date and time listed on your summons, a bench warrant for your failure to appear will be issued and you will be picked up by the police and held until you are brought in front of a Judge.</div>

These BAC readings are not available typically because the individual charged has refused to submit to a chemical test. Under these circumstances, the DUI charge is almost always accompanied by <a href="http://www.matthewtmarin.com/rhode_island_refusal_laws.html" target="_blank">a charge of refusal to submit to a chemical test</a>. The other common charges on a DUI summons are DUI (BAC Over 0.15) which indicates that breath or blood evidence indicates that the individual had an elevated blood alcohol content to the point where it exceeds 0.15. DUI (BAC 0.10-0.15) and DUI (BAC 0.08-0.10) are fairly self explanatory and indicate blood alcohol readings within sets of ranges enumerated by the Rhode Island DUI statute.</div>
